This does not circumvent or render null the Canadian Constitution that all citizens will be considered innocent until proved to be guilty.
People are confusing the actions of the Police, with the reality of the judicial system. The Police can accuse anyone of anything, but they have to prove it. If they don't have solid, demonstrable proof, but have acted as if they do, they are held accountable by a Police Disciplinary Review. In this case, charges are thrown out, the criminal record expunged, and compensation awarded to the injured party.
People are charged daily for many things, the vast majority go free. Canadians have some of the greatest freedoms and best rights in the world, that's why so many people flock here from other countries, and we welcome them with open arms. If you don't understand what your rights are then instead of complaining, go ask questions, get answers, feel secure.
`Compensation awarded to the injured party` Good luck with that. After you`ve gone broke paying all the expenses to fight your case your adversary could declare bankruptcy or worse , drag the case out longer and it gets thrown out of court. Either way you are toast.
In Canada you can be sued by anybody for anything and you have to pay the price. Guilty or not.
As far as compensation to the injured party. Again , good luck , the party with the deepest pockets (best lawyers) wins.
