first off a lawyer is a business man or woman, deal with them as thus, he should charge 1/4 if out of court and 1/3 if in court, now that being said 800 is way too much ask him to use someone less expensive, first of all cost for mailings and other come out then he gets his share of settelment.

i would consult a lot more than one lawyer....if you have a solid case, and you will profit from suing, then go ahead... you may end up settling out of court as one member said, but this usually happens when the other side knows it will loose... settling out of court just allows for them to save face and most importantly, to save money... the fact that they 'maybe' go to court and you will have to pay thousands in legal fees doesnt give me the impression that your case is solid enough to settle out of court...or that your lawyer has taken an interest in seeing where the case may end or researched into the case enough to give you a solid answer... check with your local government agencies to see if you have a case as well...see if they would be willing to take action on your behalf... if it is found that your employer is guilty, your employer might make things right without you even having to go to a lawyer...your employer going to court is bad for business and his reputation... |

Depends on the case. I've been in and out of court several times, both receiving and giving. If your case is civil and not criminal, the customary lawyers fee is 1/3 of the award. As far as stenos go, the court always has one present as a matter of law. If you need a transcript of your civil trial, simply ask for a "copy" (should only cost a few dollars at most). Do not let your lawyer BS you into any "out of pocket expensive". You simply tell him to "triple any additional cost" and roll those fees into the final judgment so that he's reimbursed and you see more of the final damages awarded you..... good luck! Just remember "consignment is consignment, period" the lawyer takes your case on "merits", an so shoulders all cost and responsibility. Make sure you get everything in writing, I mean EVERYTHING, that includes any spoken agreements between you and your lawyer. In fact buy a cheap tape recorder and tape everything said. If your lawyer forbids you to tape, get another lawyer. |
