there are awalys other laws to over come or take presidance over other laws you might want to read the DMCA

Nice spin but it won't fly. People were gettin certified letters for buyin smart card readers back when and they have a multitude of uses. I won't shoot any planes down but I am thinking of charging them a fee for using my airspace. We must all own some lots on various planets if this is taken literally but remember, your really guilty until proven innocent and not the other way around. I don't think there's an attorney on earth that would take this arguement to court on a contingency basis. Try to moralize this any way you want but your still stealing!

My understanding and I could be wrong is that Air Space is Nationlized and Free domain unless you are able to enforce your will, (aka Government)

Its almost like we don't have the rights to the ora underground

Anything that the common people or inventive people find to go around the system, is deemed Unlawful

I am not talking about theft of property or malice,

But when you can descramble a signal for your use should be aloud, just because the Signal people try to get cheaper by broadcasting in the open air, you would have to expect that.

But Dont the Government do this all the time, in the name of defense.

Something I've looked at and think could be used as a good defense is, (The Federal "Discard Law"). This law was enacted to allow law enforcement to legally search your curbside trash for contraband i.e. drugs/ messages/ recipes, excreta.
The theory is that once (personal property) is discarded like say (i.e. a satellite signal), it becomes the property of whoever receives said property. This law has been used successfully in many court cases. If you used it in your defense and a judge over turned it, it would in fact over turn several thousand drug convictions that used the "discard law" to win convictions. Think about it.... and research it!
