Actually on a similiar note: A guy wrote documents ( apperently fictious stories )on Futureshop computer( FS employee ) about child molesting and was charged with the crime even though he never committed offence, and now faces pediphile wrap.

And the way they went after DAVE users, they don't need to really prove much( purchase of equipmemt/ownership, belonging to forums that support only 3rd party bins,you replying in a 3rd party bin discussion etc. ), but you will have to prove more of a defence

That thankfully is NO Longer the case.

Daves last efforts doing this to people who actually fought the issues were thrown out of civil court.

I think Dave did us a favor by eventually poisoning the legal waters for his type of endeavor, lol.

Gonna be much harder for Charlie to get civil court judgments, should he decide to go after end users. Mere possession of the means no longer qualifies for an automatic award, the way Dave got away with.

But what if not only possesing the equipement you also are connected to a server 24/7 that has no other use than to send you de-encypted satellite signals? I would think it would be a slam dunk for the providers.

The trick here, of course, is to prevent the server from being compromised. House it in an off shore location not subject to the DMCA. I think some third world countries give the big finger to subpoena requests from the USA.

That makes it much more difficult as you would then have to monitor traffic across the network in to and out of suspect country to capture data.

Its been quite a while, but DTv didnt base their lawsuits on posts at sites, they followed the money trail by getting the customer lists from the dealers they busted. the dealers admitted that they sold pirate devices. Then it was simply a matter of filing in federal court.
The only person ( other than a dealer) where forum posts were used was ump 35, and thats because he sold equipment on the same forum that he posted on, and included a real email addy. Being a national league umpire made him a prize.
Not all federal courts agreed to throw out the lawsuits, only a few did. But that doesnt prevent Dish from doing it in state court. the beauty of a lawsuit is that each side pays for their own costs, and they dont sue to win, they dont need the win. Lawyers cost money, by the time you hit $3000 in costs, you havent even gotten to discovery where they will ask that you supply all your forum ids, and any other evidence they think you might have. refuse and they get a default judgemen. If you still havent suffered enough, they raise the amount they want and do some more discovery. You cant force them to court and they can string you along. Once they tire of you, they drop the suit. no harm no foul and they dont pay for your lawyer or time.
It still comes down to the dealer records, if your IKS supplier has any operation traceable to the US or Canada ( like where the money goes or is banked) they will get the records. Most every DTV dealer that said they kept no data lied. When busted, turning over that data allowed them to keep their house. And if they say they are all overseas, dont beleive it either. protect yourself, they will turn on you when they are threatened.

i have been in this hobby since the old f card from dtv until today with n3, .the people who are geting busted are the ones who talk to much about what they are using . most guys that i know off who have been busted using iks receviers , all iks were bought ready to go plug and play this is not recomened at all.then they have u . as ive seen in many post its all about monet fta will be here for many mant years to come n3 is all about money . and so was n3 n1 etc. WILDCHILD

people dont get busted by talking they get caught with $ 20.000 dollars and offering $250.000 for a working nag3 fix this is how folks get caught lmfao
